(a) The road built entering Forest Grove Subdivision will be constructed in accordance with State specifications for such a road. Road 1 will be Forest Grove Drive, Road 2 will be Hardwood Drive, Road 3 will be Treetop Court and Road 4 will be Treeline Court. The lot owners shall join in a petition to the State to take over the maintenance of the road as soon as criteria are met for the State to be able to assume maintenance. Between the time of the completion of construction of the road and the State taking responsibility for maintenance, and owners of lots in the subdivision shall be responsible for costs of maintenance and repair of said road on a pro-rata basis per lot. Determination of need and cost shall be made by the Homeowners Association. BY ownership of a lot in the subdivision, lot owners shall be deemed to have promised and become liable to pay any assessments levied. (b) Driveways. All driveways, drainage ditches, and walkways which shall join or be situated in the rights of way of the roads, streets, and courts which afford access to the lots in any section of Forest Grove shall be constructed in such a manner as to be consistent with the then existing requirements of the North Carolina Department of Transportation, so that no corrective work will be required to be made on the roads, streets, or courts to be taken over for maintenance by the North Carolina Department of Transportation. All drives, pipes, or sidewalks must be constructed according to and in compliance with State specifications required for the State to take over maintenance of said roads. (c) Use of Rights of Way. The use of the area designated on recorded plats and in any restrictive covenants for a right of way for a public street, road, or court is subject to the use of said right of way for the road, street, or court. Nothing shall be constructed within said right of way except for an extension for a driveway which shall meet state specifications as stated above. This shall include mailboxes, columns, entrance pillars, or shrubbery. |
